I'm struggling to believe that the contrast-based focus detection would stand up to a challenge in court.  There's a huge amount of prior art for that.

Deciding when it might be appropriate to switch between focusing modes might be a different matter.

Interesting I wonder how accurate it would be in comparison to using a focusing mask.
