Legal position with this Ebay ad

Looking through ebay I came across this item for sale by one of our favourite retailers Skywatcher 150P on EQ5 mount. Reading further down the description it may not be an EQ5 mount but an EQ3-2 mount. If I bought the item would I expect to receive the goods as described or the 150P/EQ3-2 combination. Would I have the legal right to uphold the seller to the 150P/EQ5.

You are correct about the vague description Peter. The Description mentions EQ3-2 as well as EQ5.

I wouldn't risk buying in the hope you will force them into supplying the EQ5, should it come with the EQ3-2.

Send them a question via the Ad page, and keep their reply as evidence. Should they state it is The EQ5, and it arrives with the EQ3, then you do have a strong case. This sale can't be a lucky dip, it is either one mount or the other.;)

The price advertised on the same as Telescope Planet sell their Skywatcher 150mm on EQ3/2 for.

I think they've slipped up and put the EQ5 up instead., I guess its a personal choice whether its worth buying it and potentially getting embroiled in legal action over when an EQ3/2 arrives at your door.

I know that this sale is for the 150P/EQ3-2, but someone new to astronomy who doesn't know their az from their alt may buy this not knowing the difference between the two mounts and think that £249 seems a good price for a package costing about £350.

Fair enough, good point but your first post made it sound like you were weighing up buying the item, were unsure of whether it was an EQ5 or an EQ3/2 and was asking advice over the purchase (and possible impending legal action).

I saw this in the sky at night ad page.. well it was certainly an 150P with a 9x50 finder, thats not standard. But whats to say theh have not bought stock and made up their own rig to sell?..

I just wondered what the legal position would be, I wasn't planning a buying a telescope from that company. I have only bought one item from TP, my DMK21 and only because they where the cheapest. It did arrive promptly so I can't really complain about their service. Are they legally obliged to sell the 150P/EQ5 at £249 or could they wriggle their way out?

Looking at the photo of the "150P/EQ5" on the ebay ad, it looks more like a 200P/EQ5.

I agree, it's not the 150P, mine is sat behind me, and that's definitely more like a 200P or having thought about it, maybe it's a pic of a 150PL squashed up a little ;)

Really bad advert, maybe they're thinking a EQ3-2 is actually a EQ3+2 making an EQ5, and £250's a bit pricey seeing as FLO have it for £219 :)

Going by the bad reviews on the internet about this company & their eBay feedback is not great,I would not touch them with a barge pole.

If the eBay listing is a genuine mistake or intentionally meant to mislead, is just not good enough, especially for a so-called telescope specialist.

I hate seeing deals like this as I actually found myself contemplating, if only for a minute or so, actually buying one, then I pictured my wifes reaction and my bank statement :)....but even then I thought about it a bit more, before being strong enough to resist ! ;)
