The person in question did the opposite and the code was clearly hijacked IMHO - This is not Microsoft or other large corp chasing the small person. 

No matter what the other person may say in defence - and he/she admits using the code or parts of it  - clearly it breaks the above permissions.

Nothing more to be said please don't do it
